Terms of Use

1. Acceptance of Terms

By registering for or using OrbitPrep ("the Platform"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Platform. These terms apply to all users, including parents, guardians, and students.

2. About OrbitPrep

OrbitPrep provides online exam preparation services for students sitting the ACER-style Selective School Entrance Exam in Australia. The Platform offers adaptive diagnostic tests, full-length timed practice exams, and performance analysis tools. OrbitPrep operates as a practice and preparation tool only — it is not an official examination body and results carry no formal weight.

3. Account Registration

You must be 18 years or older to create an account. Accounts are created on behalf of minor students by their parent or guardian. You are responsible for:

• Providing accurate and up-to-date registration information
• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account

You must notify us immediately at hello@orbitprep.com.au if you suspect unauthorised access to your account.

4. Purchases and Payment

Access to full practice exams and extended diagnostic tests requires a paid purchase. All prices are in Australian dollars (AUD) and are inclusive of GST where applicable. Payment is processed securely via Stripe. OrbitPrep does not store your payment card details.

Current purchase options include single-test packs and monthly subscriptions. Pricing, inclusions, and availability may change over time. The price at the time of purchase applies to that transaction only.

5. Refund Policy

Refunds are available on unused test packs under the following conditions:

• A $5 administration fee applies to all refunds
• Refunds are calculated on a pro-rata basis: unused tests ÷ total tests purchased × amount paid, minus the $5 fee
• Refund requests must be submitted through the Platform's refund flow (Account → Purchases)
• Once a test has been started it is considered used and is not refundable, regardless of whether it was completed

The following purchases are not eligible for refunds:

• Monthly subscriptions
• Purchases made using a promo code
• Single-test packs where the test has already been started

Refunds are processed to the original payment method within 5–10 business days. To request a refund, use the in-platform refund flow or contact us at hello@orbitprep.com.au.

6. Subscriptions and Cancellation

Monthly subscriptions renew automatically each billing period until cancelled. You may cancel your subscription at any time through the Account section of your dashboard. Cancellation takes effect at the end of the current billing period — you retain access until that date. No partial-period refunds are provided for subscription cancellations.

7. Fair Use

Monthly subscriptions are subject to a fair use cap on the number of full practice exams that may be taken per billing period. This cap exists to ensure platform stability and is disclosed at the time of purchase. Diagnostic tests are unlimited for subscription holders.

8. Use of the Platform

You agree to use OrbitPrep only for its intended purpose — exam preparation for the student named on your account. You must not:

• Share account credentials with others outside your immediate family
• Attempt to reverse-engineer, scrape, or copy questions, answers, or explanations from the Platform
• Use automated tools, bots, or scripts to interact with the Platform
• Submit false or misleading information
• Attempt to circumvent or manipulate the adaptive difficulty system

9. Disclaimer of Warranties

OrbitPrep is provided "as is" and "as available." We make no warranty that the Platform will be error-free, uninterrupted, or that results will predict performance in any official examination. Practice test results are indicative only. We do not guarantee that use of OrbitPrep will improve a student's exam score or result in selection to a selective school.

10. Limitation of Liability

To the maximum extent permitted by Australian law, OrbitPrep and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability to you for any claim shall not exceed the amount you paid for your most recent purchase.

11. Intellectual Property

All content on the Platform — including questions, explanations, diagrams, software, and design — is the intellectual property of OrbitPrep. You may not reproduce, distribute, or create derivative works from any Platform content without prior written permission.

12. Privacy

Your personal information is handled in accordance with our Privacy Policy. By using the Platform, you consent to the collection and use of information as described in that policy.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. We will notify registered users of material changes by email.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
